I've seen your mail and the screenshots attached on it, but however, this does not really proves a lot to me... Basically we just have Ryokouji stating that the tracks have been reused in other games, and that the fanart logo is a coincidence (but I don't think this is actually one, as both Oris are pixel-perfectly the same...)
Unless you have a valuable object of proof, I don't think I can consider it seriously. If this Ryojouki is the "real" maker, why doesn't he have a copy of the game?
